In short: the Platform is licensed, not sold. You may read and use your own measurement data freely. You may not reverse engineer, decompile, or otherwise attempt to derive the signal processing, calibration, or analytical methods behind it, and you may not use it to build or assist a competing product. The full terms follow, and they, not this summary, are what binds.

1. Introduction and acceptance

These Terms of Use ("Terms") govern your access to and use of the Segura Dashboard at app.segura-water.com, the Segura Public API at app.segura-water.com/api, their documentation, and any data, output, or software made available through them (together, the "Platform").

These Terms form a binding agreement between you and us. You accept them by any of the following, whichever happens first: creating a Dashboard account; signing in; being issued or using an API key; or otherwise accessing the Platform. If you do not agree to these Terms, do not use the Platform.

If you are accepting these Terms on behalf of an organisation, you represent that you have authority to bind that organisation, and "you" means that organisation. These Terms apply to your employees, contractors, and agents, and you are responsible for their compliance.

These Terms govern the Platform. The public marketing site at segura-water.com is governed by its own Terms of Use. Where a signed written agreement between you and us covers the same subject matter, that agreement prevails over these Terms to the extent of any conflict.

2. About us

The Platform is operated by Advanced Water Testing Ltd, trading as Segura, a company registered in England and Wales, with its registered office at 3rd Floor, 86–90 Paul Street, London EC2A 4NE, United Kingdom. "We", "us", and "our" refer to Advanced Water Testing Ltd.

Dashboard accounts are granted by administrator approval, not by self-service signup alone. API keys are issued individually by a Segura administrator. Access is personal to the account or key holder and is licensed, not sold.

5. Licence granted to you

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to access and use the Platform, and to use the Output, for your own internal water-quality testing, monitoring, reporting, and regulatory purposes.

That licence includes the right to store, analyse, and redistribute Output that relates to your own samples — including publishing results, filing them with a regulator, or passing them to a client. It does not include any right to the Platform Materials beyond using them as the Platform intends.

All rights not expressly granted are reserved. No right is granted by implication, estoppel, or otherwise.

6. Restrictions — reverse engineering and derivation

This section is the core of these Terms. Segura's value is in how a raw voltammetric sweep becomes a defensible concentration, and that method is proprietary. You must not do any of the following, and must not permit or assist any third party to do them.

Where applicable law grants you a non-waivable right to decompile software for interoperability, nothing here limits that right — but you must first give us written notice at [email protected] and a reasonable opportunity to supply the interoperability information you need. We will normally do so, because a documented interface is better for both of us than a guessed one.

8. Confidentiality and trade secrets

The Platform Materials — in particular the signal processing pipeline, its parameters, and the calibration and analytical methods — are our confidential information and trade secrets, protected under the Trade Secrets (Enforcement, etc.) Regulations 2018 and the general law of confidence. Providing you with access to the Platform does not place them in the public domain.

You must keep them confidential, use them only as these Terms permit, and not disclose them to any third party. This obligation survives termination and continues for as long as the information remains a trade secret. It does not apply to information that is or becomes public through no act of yours, that you already lawfully held without restriction, or that you are required to disclose by law or court order — in which case, tell us first if you lawfully can.

You acknowledge that damages alone would be an inadequate remedy for breach of section 6 or this section, and that we are entitled to seek injunctive relief and specific performance without needing to prove special damage or provide security.

9. Intellectual property

We and our licensors own all right, title, and interest in the Platform Materials, including all copyright, database rights, trade secrets, patents, trademarks, and other intellectual property in them. These Terms grant a licence to use the Platform; they transfer no ownership.

"Segura", the Segura logo, and related product names are trademarks of Advanced Water Testing Ltd. You may not use them without our written consent, except to identify the Platform accurately in factual statements.

If you send us feedback, suggestions, or bug reports, we may use them without restriction or obligation to you. You are not required to send us feedback.

10. Your data

Your Data remains yours. You grant us a non-exclusive, worldwide licence to host, store, process, transmit, back up, and display it solely to operate and support the Platform for you, to keep it secure, and to comply with law.

We may compute aggregated and de-identified statistics from Your Data to operate, secure, and improve the Platform. Anything so derived will not identify you, your organisation, your customers, or any specific sampling location, and we will not publish or sell Your Data.

You are responsible for the accuracy and lawfulness of what you submit, for having the right to submit it, and for retaining your own copies. Exports are available through the Dashboard and the API — use them. On termination we may delete Your Data after a reasonable period; ask us before then if you need an extract.

11. Screening tool, not a certified laboratory

Segura is a screening tool designed to support, not replace, accredited laboratory confirmation where regulatory certification is required. Do not rely on the Platform alone for a compliance, public health, or safety decision that requires certified analysis.

The Platform is intended for use by trained water-testing professionals, utilities, and authorised partners. Results depend on sample handling, strip condition, calibration currency, dilution, and operating conditions that are outside our control.

Read qualifiers before values. A null value with a not_detected qualifier means no peak was found; it does not mean zero and must not be recorded as zero. below_detection is not a pass. A compliance status is judged against a named standard given alongside it, and an action level is not a per-sample health limit. Misreading these is the most likely way to reach a wrong conclusion from correct data, and you are responsible for reading them correctly.

12. Availability and changes

We aim to keep the Platform available but do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue any part of it, and will give reasonable notice of material adverse changes where practicable. Maintenance, updates, and emergency security work may cause downtime without notice.

13. Suspension and termination

We may suspend or terminate your access, revoke an API key, or close an account immediately and without notice if we reasonably believe you have breached section 6, section 7, or section 8, or where required by law or necessary to protect the Platform or its users. For other breaches we will give notice and a reasonable chance to fix the problem where it is capable of being fixed.

You may stop using the Platform at any time; ask us to close your account or revoke your keys and we will. Sections 6, 8, 9, 10, 14, 15, 16, 20, and 21 survive termination.

14. Disclaimer of warranties

To the fullest extent permitted by law, the Platform and the Output are provided "as is" and "as available". We make no representations or warranties, express or implied, including any implied warranty of satisfactory quality, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted availability. Any reliance you place on the Platform or the Output is at your own risk, subject to section 15.

15. Limitation of liability

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited under English law.

Subject to that, we will not be liable to you — whether in contract, tort (including negligence), breach of statutory duty, or otherwise — for any loss of profit, loss of business, business interruption, loss of anticipated savings, loss of goodwill, loss or corruption of data, or any indirect or consequential loss, arising under or in connection with the Platform.

Subject to the first paragraph of this section, our total aggregate liability arising under or in connection with these Terms in any twelve-month period will not exceed the greater of (a) the total fees you paid us for the Platform in that period, and (b) £1,000.

16. Indemnity

You will indemnify us against all liabilities, costs, and reasonable legal expenses arising from your breach of section 6, section 7, or section 8, from your unlawful use of the Platform, or from a third-party claim that Your Data infringes their rights or was submitted unlawfully.

17. Privacy

Your use of the Platform is also governed by our Privacy Policy, which explains how we handle personal data under the UK GDPR and the General Data Protection Regulation. Sample metadata you submit may include operator names and GPS positions; you are responsible for having a lawful basis to submit personal data about other people.

18. Export control and sanctions

You must comply with all applicable export control and sanctions laws. You may not access or use the Platform if you are subject to UK, EU, UN, or US sanctions, and you may not make the Platform available to anyone who is.

19. Changes to these Terms

We may update these Terms. The current version is always published at app.segura-water.com/terms and carries a version stamp at the top of the page. We will give notice of material changes by email to account holders and key holders, or in the Dashboard, before they take effect. Continuing to use the Platform after that means you accept the revised Terms.

21. Governing law and jurisdiction

These Terms, and any dispute or claim arising out of or in connection with them or the Platform (including non-contractual disputes or claims), are governed by and construed in accordance with the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, save that we may seek injunctive relief in any court of competent jurisdiction to protect our intellectual property or confidential information.
